CCPA California Notice Cybersecurity

In compliance with the California Consumer Privacy Act of 2018 (CCPA) and subject to applicable legal exceptions, it is important to clarify that personal information, as discussed herein, does not include data that has been de-identified or aggregated. Additionally, in alignment with the CCPA’s stipulations, our practices ensure that we do not and will not sell your Personal Data, affirming our commitment to your privacy rights.

Under the CCPA, California residents are granted specific rights concerning their Personal Data, which we gather. These rights encompass:

The Right to Know: You have the right to be informed about the Personal Data we collect, its use, and its sharing.

The Right to Delete: You have the right to request the deletion of your Personal Data.

The Right to Opt-Out: You are entitled to opt-out of the sale of your Personal Data, a practice our organization does not engage in.

The Right to Non-Discrimination: You are entitled to non-discriminatory treatment for exercising any of your privacy rights.

The Right to Access and Portability: You have the right to request access to your Personal Data and, where technically feasible, to have it provided in a portable format.

To address these rights, including requests for access, portability, or deletion of Personal Data, please contact us at ccpa@kyla.com. It is crucial to recognize that without necessary data, the continuation of our Service is not feasible; thus, uninstalling the App from your device might be suggested, leading to your account’s non-functionality.

When submitting a verifiable request, you should be prepared to:

Provide sufficient information to allow us to reasonably verify you are the person we have collected data from or an authorized representative. This may include your name, address, city, state, zip code, and email address, based on which we may pose security questions to confirm your identity. Authorized agents must present written confirmation or a power of attorney from you.

Describe your request clearly so we can understand, evaluate, and respond appropriately.

Without the ability to verify your identity or authority for the request, or to confirm the personal information relates to you, we cannot fulfill your request. We may request additional information or documents for verification, including third-party identity verification services, as necessary to ensure the security and privacy of your personal information.

Personal information provided in a verifiable consumer request is used solely for verifying the requester’s identity or authority and not for other purposes. This information will be retained for a period deemed reasonably necessary for this purpose and subsequently deleted.

Our goal is to respond to verifiable consumer requests within forty-five (45) days of their receipt. If more time is needed, we will inform you of the extension and its reasons in writing. Note that we are obligated to respond to two requests per customer annually.

Our handling of your request will not result in discriminatory treatment, ensuring no difference in pricing, products, service levels, or quality if you exercise your rights. However, some services may be affected if you opt to have your personal data deleted from our records.
